Tax Sale Deed

The State of Texas

County of Angelina

Know all men by these presents that whereas certain Taxes are due the state of Texas and the county of Angelina by virtue of the assessment roll of 1893 as assessed against it for the year 1893 upon the following described tract or parcel of Land viz: Four Hundred and Eighty acres of the John McAnnally Survey in Angelina county, Texas, which taxes amounted to the sum of Six Dollars and Eighty three cents as appears from the Tax Roll of said County for the year 1893. And whereas the time provided by law for the payment of said Taxes having expired and though Demanded of the said J.B. Cochran Sr. by proper legal notice the same remaining unpaid I, B. F. Nerren, Tax Collector of Angelina county in compliance with the Law and by virtue of the Tax roll aforesaid – levied upon and Seized certain tract of land belonging to the said J. B. Cochran, Sr. and hereinafter described to be sold to make the said amount of said Taxes yet unpaid together with costs accrued and have advertised the said lands in the manner and for the time required by Law and whereas in persuance (sic) with said advertisement I did offer said lands for sale at Public Auction at the time place and in the manner required by law; when J. T. Maroney bid the sum of Six Dollars and Eighty three cents for 480 acres of said Land which sum being sufficient to make the said amount of said unpaid Taxes together with One Dollar and Seventy five cents penalties due and Three Dollars and Twenty five cents costs accrued thereon and the costs of this Deed which being the highest and best bid offered for the Least number of said acres of said Land the same was stricken off to him the said J. T. Maroney.

Now therefore for and in consideration of the sum of Eleven Dollars and Eighty three cents to me in hand paid the receipt of which I hereby acknowledge, I have by virtue of the power in me vested by law and by these presents Bargained, Sold, Transerred and Conveyed and by these presents do Bargain sell Transfer and convey unto him the said J. T. Maroney his heirs and assigns all the right title interest and estate which the said J.B. Cochran Sr. had at the time when the assessments before mentioned was made, to the following described tract or parcel of Land viz: Four Hundred and Eighty acres of the John McAnnally survey of land in Angelina County Texas. To have and to hold unto him the said J. T. Maroney his heirs and assigns the above and foregoing tracts of Land together with all and singular the rights privileges and appurtenances to the same belonging or in any way appertaining in fee simple forever. Provided nevertheless that the said Land herein conveyed may be redeemed by the said J. B. Cochran Sr. (owner) or by his heirs or his Legal representatives within two years from this date in the manner provided by Law.

County of Angelina

Know all men by these presents that I, J. B. Cochran of said county and state for an in consideration of the natural love and affection that I have for my wife Lavonia Cochran of said county and state and for the further consideration of the sum of Twenty five Dollars to me cash in hand paid by the said Lavonia Cochran the receipt of which is hereby acknowledged and for the further consideration that I am Justly indebted to the said Lavonia Cochran the sum of Eight-hundred dollars and by way of paying said indebtedness I have this day bargained sold transfered aliened and conveyed and by these presents do hereby bargain sell transfer alien seige and convey unto the said Lavonia Cochran her heirs and assigns forever in fee simple title and possession the following described property to wit,

One ten horse power steam engine and boiler of the Skinner & Wood make. Also one Grist mill and one fifty saw gin stand of the windship make, and one Iron pin cotton press and all fixtures pertaining to said machinery to include everything in and about said machinery to make the same complete and belonging thereto said property being situated on my homestead farm place where I now reside in Angelina County Texas about 21½ miles East from the town of Lufkin.

Also 20 head of stock cattle running in the range in and about my said premises in said county of Angelina. Said cattle being marked with crop and split in the left and swallow fork and underbit in the right ear, and branded on the hip thus  (the mark on the deed is a diamond with C in the middle).      

Also one hundred acres of land the same being a part of the Patric Mullen League of land situated in the said county of Angelina State of Texas. The said 100 acres of land herein conveyed is described as follows, Being in the most Northwest Corner of the said Patric Mullen League of land Bounded on the Northwest by the Northwest boundary line of said League of Land and on the Northeast by the Northeast Boundary line of said League, said 100 acres of Land herein conveyed is to be in a or near a square shape.

And I hereby put the said Lavonia Cochran in the full and complete possession of all the property herein conveyed together with all and singular the rights members hereditaments appurtenances increasements tolls and profits to the same belonging or in anywise incident or appertaining to have and to hold all and singular the property above mentioned unto the said Lavonia Cochran her heirs and assigns forever, and I do hereby bind myself my heirs executors Administrators and assigns to forever warrant and defend the title to all of said property to the said Lavonia Cochran her heirs and assigns against the claim of all persons whomsoever lawfully claiming or to claim the same or any part hereof either in law or equity.

Know all men by these presents that I, J. B. Cochran, of the County of Angelina in the State aforesaid, for an in consideration of the sum of Fifty Dollars as follows to be deducted from Wallace W. Cochran’s interest in my personal and real estate at my death and for the further consideration of the love and affection that I have for him as my son have granted sold and conveyed and by these presents do grant sell and convey unto the said Wallace W. Cochran of the County of Angelina and State of Texas, all that certain tract or parcel of land situated in Angelina County, Texas, about 15 miles Eastwardly from the town of Homer and being a part of the Thomas Hanks Survey of land and bound as follows, to wit:

On the west by the East boundary line of fifty acres of land deeded to D.J. Cochran by me off of 160 acres of the said Thomas Hanks Survey and on the North by continuing on the line of said D. J. Cochrans, North boundary line a sufficient distance so as to make a corner and run south to the south boundary line of the 160 acres of the said Thomas Hanks that this conveyance is a part of and so as for the tract of land herein conveyed to contain Fifty acres of land by returning with the said south boundary line of the 150 acres of the said Thomas Hands Survey to the S.E. Corner of the said 50 acres of land heretofore deeded to D. J. Cochran by me but is especially stipulated and hereby understood that this conveyance is not to conflict with three acres heretofore deeded to W.R. Shofner by me but this conveyance is to contain fifty acres of land and when surveyed the lines are to run so as to contain 50 acres over and above any conflict to may occur by reason of the above mentioned three acres having been formerly deeded to W. R. Shofner.

To have and to hold the above described premises together with all and singular the rights and apurtenances thereto in any wise belonging unto the said Wallace W. Cochran his heirs and assigns forever, and I do hereby bond myself y heirs executors and administrators, to warrant and forever defend all and singular the said premises unto the said Wallace W. Cochran, his heirs and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof.

Know all men by these presents that I Joshua B. Cochran, (sen) of the County of Angelina in the State of Texas, for an in consideration of the sum of Fifty Dollars to me paid in board, and clothing, by Joshua B. Cochran, Jun., the receipt of the same is hereby fully acknowledged, have this day Granted, bargained, sold, and conveyed, and by the presents do Grant, bargain, sell, alien, and convey unto the said Joshua B. Cochran Junior of the county of Angelina in the State of Texas, all the right title, interest and claim, that I have in and to 150 acres of land off of the Patrick Mullen League of land, my said claim being a Limitation title, Described as follows to wit:

Situated in Angelina County, Texas, about 15 miles Eastwardly from the town of Homer and begins at the most NorthEast corner of said Patrick Mullen League, and run to as to include 150 acres of land described in the field notes hereto attached.

To have and to hold the same unto him the said Joshua B. Cochran, Junior his heirs and assigns forever, and I do for myself my heirs and assigns release quit claim unto the Joshua B. Cochran Junior his heirs his heirs assigns forever against the claim or claims of any and all persons whomsoever claiming as to claim the same or any part thereof by, through me my heirs or assigns and no further.

Know all men by these presents that I J. B. Cochran of the county of Angelina and State aforesaid in consideration of the sum of Sixty ($60.00) Dollars to me in hand paid by D. A. Cochran have granted sold and conveyed and by these presents do grant, sell and convey unto the said D. A. Cochran of the County of Angelina and State of Texas all that certain lot or parcel of land situated in Angelina County Texas about 21½ miles east from the town of Lufkin and being a part of the Patrick Mullen League and situated in the northeast corner of said league of land and being a part of a one hundred and sixty (160) acre tract of land deeded to me by J. B. Cochran, Sr. and being the northwest portion of said one hundred and sixty (160) acre tract of Land and to include the place where the said D. A. Cochran has built and the place known as D. A. Cochran residence the tract of land herein conveyed to include sixty (60) acres of land.

To have and to hold the above described premises together with all and singular the rights and appurtenances thereto in anywise belonging unto the said D. A. Cochran his heirs and assigns forever. And I do hereby bind myself my heirs executors and administrators to warrant and forever defend all and singular the said premises unto the said D. A. Cochran his heirs and assigns against every person whomsoever lawfully claiming or to claim the same or any part hereof, by or through me,
